Terms and Conditions

Effective date: 9/16/2026

Last updated: 9/16/2026

1. About these Terms

These Terms and Conditions ("Terms") govern your use of the website at bcsportfishinggroup.com (the "Website") and your purchase of and participation in any fishing trip, charter, adventure trip, package, derby entry, gift card, merchandise item or other product or service offered by BC Sportfishing Group (each, a "Service").

BC Sportfishing Group is operated by BC Sport Fishing Group Ltd., a company incorporated in British Columbia, Canada, with its principal place of business at 100 Esplanade Avenue, Harrison Hot Springs, British Columbia V0M 1K0. In these Terms, "we", "us" and "our" mean that company, and "you" and "your" mean the person using the Website or booking or participating in a Service.

By using the Website, making a booking, placing an order, or participating in a Service, you agree to these Terms. If you are booking for other people — as is usual for group, corporate and multi-boat trips — you do so as their agent, and you confirm that you have their authority to accept these Terms on their behalf and that you have brought these Terms to their attention. If you do not agree to these Terms, do not use the Website and do not book with us.

Please read these Terms alongside our Privacy Policy, which forms part of them.

2. Who may book

You must be at least 19 years of age (the age of majority in British Columbia) and have the legal capacity to enter into a binding contract in order to make a booking or place an order. Participants under 19 may take part in a Service only with the consent and accompaniment of a parent or legal guardian, and a parent or legal guardian must sign the waiver on their behalf. Any angler aged 16 or over requires their own fishing licence (see section 11).

3. Using the Website

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Website for your own personal, non-commercial purposes, and to make bookings and purchases with us. You must not:

  • use the Website for any unlawful, fraudulent or harmful purpose;
  • make any speculative, false or fraudulent booking or order;
  • copy, reproduce, scrape, data-mine, frame, mirror or republish any part of the Website except as expressly permitted;
  • use any robot, spider, scraper or other automated means to access the Website without our written permission;
  • attempt to gain unauthorised access to the Website, its servers, or any connected system;
  • introduce any virus, malware or other harmful code;
  • interfere with the proper working of the Website; or
  • use the Website in a way that infringes the rights of any other person.

We may suspend or terminate your access to the Website at any time, without notice, if we reasonably believe you have breached these Terms.

4. Intellectual property

All content on the Website — including text, photographs, video, graphics, logos, trade marks, page layout, design and software — is owned by us or our licensors and is protected by Canadian and international copyright, trade mark and other intellectual property laws. The names "BC Sportfishing Group", "Harrison Sturgeon Challenge", "Fish, Play & Stay", "Fins 'n' Skins", our logo, and our trip names are our trade marks.

You may view, download and print pages of the Website for your own personal use in connection with a booking. Any other use requires our prior written permission. Nothing in these Terms transfers any intellectual property right to you.

5. Content you submit

If you submit a review, testimonial, photograph, video, comment or other content to us or to our social media pages ("User Content"), you confirm that it is your own, that it is accurate, and that it does not infringe anyone else's rights or breach any law.

You grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sub-licensable licence to use, reproduce, adapt, publish and display that User Content in connection with our business, including in our marketing, on our Website and on social media, with attribution to your first name or display name unless you ask otherwise. You may ask us to stop using your User Content at any time and we will remove it from the channels we control as soon as reasonably practicable.

We may remove or decline to publish any User Content at our discretion, and we do not endorse and are not responsible for User Content submitted by others.

6. Bookings

6.1 Making a booking

You may book through our online booking system, by telephone on 1-877-796-3345, by email to info@bcsportfishinggroup.com, or through an authorised reseller or travel partner.

A booking request is an offer by you to purchase a Service. A contract is formed only when we issue a written booking confirmation. If we cannot accept your booking — for example because the date is unavailable, the water is closed to fishing, or a pricing or availability error has occurred — we will tell you and refund any payment taken in full.

You are responsible for the accuracy of the information you give us at the time of booking, including names, angler numbers, ages, contact details, dietary requirements and any special requirements. Check your confirmation carefully as soon as you receive it and tell us immediately if anything is wrong. Your booking confirmation email also sets out the fishing licence requirements for your trip — read it, because obtaining your licence is your responsibility.

6.2 Boat and party sizes

Our standard fishing trips accommodate 4 to 5 anglers per boat. Larger parties will be split across multiple boats, which may be operated by us or by a partner operator. Unless you have booked a private charter, we may place other guests on your boat. If you want exclusive use of a boat, book a private charter and we will confirm it in writing.

6.3 Errors

We take care to ensure that the information on the Website and in our booking system is accurate, but errors occasionally occur. We reserve the right to correct any error before or after a booking is confirmed. Where an error materially affects your booking, we will contact you and offer you the choice of proceeding at the corrected price, rebooking, or cancelling with a full refund.

6.4 Bookings made through third parties

If you booked through an online travel agency, fishing booking platform, hotel concierge or travel agent, that party's own booking, payment and cancellation terms may also apply, and in some cases will govern your payment and refund. We are not responsible for errors made by a third-party reseller. Contact the party you booked with in the first instance for changes and cancellations.

7. Prices, taxes and payment

Currency. All prices are in Canadian dollars (CAD) unless clearly stated otherwise. If you pay with a card issued outside Canada, your card issuer sets the exchange rate and may apply a foreign transaction fee. We have no control over either. Any currency converter we link to is provided for convenience only and is not a quotation.

Taxes. Prices are subject to applicable taxes, including 5% GST, which are shown at checkout unless stated as included.

What is and is not included. Each trip page sets out what is included. Rods, reels and terminal tackle are provided. Unless stated, prices do not include: fishing licences and stamps; catered lunches; transport to and from the meeting point; accommodation; personal expenses; gratuities; travel insurance; or optional extras.

Catered lunches. Catered lunches — two sandwiches, salad, dessert, fruit and a bottle of water — are available at $27.50 + GST per person, and must be ordered in advance. Prices are subject to change; the price confirmed at the time of your booking applies. Tell us about allergies and dietary requirements when you order. We cannot guarantee an allergen-free environment on a boat, and guests with severe allergies should carry their own medication.

Gratuities. Gratuities for your guide are entirely at the discretion of the guest and are never added automatically.

Price changes. We may change our prices at any time. A price change will not affect a booking we have already confirmed, except where a tax rate or government-imposed charge changes, in which case we may pass on the difference.

7.1 Deposits and payment schedule

Unless we agree otherwise in writing:

  • A deposit of 50% of the total trip price is payable at the time of booking. Your booking is not confirmed until the deposit is received and we have issued a confirmation.
  • The deposit is non-refundable, except where we cancel the trip (see section 9) or where a refund is required by law.
  • The balance is due 30 days before the trip start date. For bookings made within 30 days of the trip, the full amount is payable at the time of booking.
  • If the balance is not paid by the due date, we may treat the booking as cancelled by you and apply the cancellation terms in section 8, meaning the deposit is forfeited. We will make reasonable efforts to contact you before doing so.

Payments are processed by our third-party payment processor; we do not store your full card details.

Groups, corporate bookings, derby entries and multi-day trips. Different deposit, payment and cancellation terms may apply and will be set out in the quotation or booking confirmation for that booking. Where they differ, those terms take precedence over sections 7 and 8.

8. Changes and cancellations by you

8.1 Cancellation policy

  • The 50% deposit is non-refundable at any point after booking.
  • Cancellation 10 or more days before the trip start date: we will issue a credit for the amount paid, valid for the same season or the following season. No cash refund is available.
  • Cancellation within 10 days of the trip start date: no credit and no refund will be issued.
  • Failure to attend (no-show), or arriving too late to join the trip: treated as a cancellation within 10 days — no refund or credit.

All cancellations must be submitted in writing by email to info@bcsportfishinggroup.com. The cancellation takes effect on the date we receive your email, and the relevant window is measured from the scheduled start time of your trip, in Pacific Time.

Credits are non-transferable and non-redeemable for cash unless we agree otherwise in writing. Refunds, where payable, are issued to the original payment method and normally reach you within 10 business days, depending on your card issuer.

Because our cancellation terms are strict, we strongly recommend that you purchase travel insurance that covers trip cancellation and interruption as soon as you book.

8.2 Reducing party size

A reduction in the number of anglers is treated as a partial cancellation and the terms above apply to the anglers removed. Where a reduction takes the party below the minimum for the boat or rate booked, the per-person price may increase.

8.3 Changes to your booking

We will do our best to accommodate a request to change the date, duration or composition of a booking, subject to availability and to any difference in price. A change requested within the 10-day window may be treated as a cancellation and rebooking.

8.4 Packages including accommodation or golf

Where your booking includes a hotel stay, a golf round or another supplier's service, that supplier's cancellation terms apply to their portion of the package and may be stricter than ours. These will be disclosed at the time of booking.

8.5 Bookings made through third parties

Where you booked through a reseller, that reseller's cancellation policy applies.

9. Changes and cancellations by us

Safety comes first. We may cancel, shorten, delay, relocate or otherwise modify any trip where, in the reasonable judgment of our guides or management, it is necessary for the safety of participants, staff or others. Reasons include severe weather (lightning, high winds, wildfire smoke or poor air quality, extreme heat or cold), dangerous river conditions, flood, freshet, high or low water, ice, debris, mechanical failure, guide illness, a medical emergency, or the direction of any authority.

Regulatory closures. Fishing on the Fraser and Harrison systems is subject to openings, closures, retention restrictions and other measures imposed by Fisheries and Oceans Canada and by the Province of British Columbia, sometimes at very short notice. Where a closure or restriction affects your trip, we will contact you and, where possible, offer an alternative target species, water or date.

Fishing is fishing. We do not and cannot guarantee that you will catch a fish, or a fish of any particular species or size. Catch rates depend on water conditions, weather, season and luck. A poor day's fishing is not a basis for a refund, a credit or a complaint.

Minimum numbers. Some trips and departures require a minimum number of anglers to operate. If the minimum is not met, we may cancel and will offer you the options below.

If we cancel before the trip starts, we will offer you, at your choice: (a) a transfer to another date or another trip of equivalent value, subject to availability; (b) a credit valid for the same or the following season; or (c) a full refund of the amounts you paid us, including the deposit, for the cancelled Service.

If we cut a trip short after it has begun for safety or regulatory reasons, we will offer a partial refund or credit proportionate to the part of the trip not delivered, determined reasonably by us. On a multi-day trip, this is normally calculated by reference to the days not fished.

The limit of our responsibility for a cancellation. A refund, credit or transfer as described above is your sole remedy for a cancellation or modification by us. We are not responsible for any other cost you incur as a result — including flights, travel, accommodation, meals, car hire, fishing licences already purchased, missed connections or lost holiday time. This is what travel insurance is for.

We may also substitute a guide, vessel, launch point or stretch of water where necessary, provided the Service remains substantially as described.

10. Arrival, meeting points and late arrival

Meeting points and times are stated in your booking confirmation and confirmed by your guide. Please arrive at the time given. Departures are timed around water conditions, daylight and the fishing, and cannot be delayed for a late angler without affecting everyone else on the boat. If you arrive after the departure time, you may be refused participation and no refund or credit will be given.

11. Fishing licences and regulations

Every angler must hold a valid fishing licence. Licence requirements depend on the water and the species:

  • Every angler 16 years of age or older requires, at minimum, a basic BC freshwater licence with a sturgeon conservation stamp.
  • A salmon conservation stamp is required in order to retain salmon.
  • A tidal waters licence is required for trips west of Mission.
  • Additional stamps, classified waters licences or restrictions may apply depending on the water and date.

Obtaining a valid licence is your responsibility. Your booking confirmation email sets out what you need — read it and act on it. We can obtain licences on your behalf if you ask us with at least 48 hours' notice, and we will need the personal information the licensing authority requires (see our Privacy Policy). Licence fees are payable by you and are not included in the trip price.

If you arrive without a valid licence and we cannot obtain one in time, you will not be able to fish. This is treated as a no-show and no refund or credit is given.

You must comply with all applicable federal and provincial fisheries regulations, including catch limits, size limits, retention rules, gear restrictions and closures, and with all instructions given by your guide in relation to them. You are personally responsible for any fine, penalty or prosecution resulting from your breach of fisheries law. We will not knowingly assist any breach of fisheries regulations, and we will end a trip immediately, without refund, if a guest insists on breaching them.

12. Conservation and fish handling

We are committed to the conservation of the Fraser River white sturgeon and of all the fisheries we work in. As a condition of joining our trips:

  • All sturgeon are catch-and-release, as required by law. Sturgeon must not be removed from the water except as your guide directs and in accordance with regulations.
  • You must follow your guide's instructions on fighting, landing, handling, measuring, photographing and releasing fish. These instructions exist to keep the fish alive.
  • We measure and record captured sturgeon and read or apply PIT tags in cooperation with the Fraser River Sturgeon Conservation Society, and submit that data to the Society's monitoring programme.
  • You must not litter, and must take all waste off the water.
  • You must respect wildlife, riparian habitat, other anglers and private property.

13. Participation: safety, conduct and fitness

13.1 Waiver and release

Every participant must read and sign a Release of Liability, Waiver of Claims, Assumption of Risks and Indemnity Agreement before taking part in any trip. A parent or legal guardian must sign on behalf of any participant under 19. The waiver is a separate legal document from these Terms, and it will ask you to give up important legal rights, including the right to sue. You will be given an opportunity to read it. If you are not willing to sign the waiver, you will not be able to participate, and no refund will be given. A copy is available on request before you book, and we encourage you to ask for it in advance if you would like time to consider it.

13.2 Fitness, health and self-assessment

You are responsible for assessing whether you and the members of your party are physically and medically fit to take part. Our trips involve long days on a boat in variable weather, boarding and disembarking at docks or shorelines, and the physical exertion of fighting large fish — a Fraser River sturgeon can be very large and the fight can be strenuous.

You must tell us before or at the time of booking about any medical condition, injury, disability, pregnancy, allergy, medication or mobility limitation that may affect your participation or that we would need to know in an emergency. We will do our best to accommodate you where it is safe to do so. We may decline participation where we reasonably consider that taking part would create an unacceptable risk to you or others.

13.3 Accessible trips

We offer customised, wheelchair-accessible, Transport Canada approved vessels, with dock and shore boarding options, guides experienced in adaptive fishing, and adaptive equipment including sip-and-puff reels. These trips must be arranged in advance so that the right vessel, equipment and guide can be assigned — please contact us well before booking to discuss your requirements. We cannot guarantee accessible equipment for a booking made without advance notice.

13.4 Rules on the water

You must:

  • follow all instructions given by your guide at all times;
  • attend and pay attention to the safety briefing and the boating etiquette briefing;
  • wear the personal flotation device provided where your guide directs, and at all times where required by law;
  • remain seated while the vessel is under way, unless your guide directs otherwise;
  • handle rods, hooks, weights and knives safely and with regard to others on board; and
  • behave courteously towards other guests, our staff and other users of the water.

Alcohol, cannabis and drugs. You must not take part while impaired. [CONFIRM YOUR POLICY: whether guests may bring and consume alcohol on board. Canadian law restricts open liquor on vessels that are not equipped as a residence, and your insurer may prohibit it outright. The default below assumes no alcohol or cannabis on board.] Alcohol and cannabis are not permitted on our vessels, and we will not depart with, or will return to the dock with, a guest who is impaired.

13.5 Our right to refuse or remove

We may refuse to allow a person to begin, or may remove a person from, a trip — without refund or credit — where in our reasonable opinion that person: is impaired by alcohol or drugs; is behaving in a manner that is unsafe, abusive, threatening, discriminatory or disruptive; refuses to follow a guide's instructions or to wear safety equipment; insists on breaching fisheries regulations; has misrepresented their age, fitness or medical condition; does not hold a valid licence; or is otherwise unfit to participate safely. In those circumstances we accept no responsibility for any cost you incur, including return transport or accommodation.

13.6 Personal belongings

You bring personal belongings on board at your own risk. We are not responsible for loss of, or damage to, personal items — including phones, cameras, sunglasses, keys and tackle — whether on our vessels, in the water, at the dock or in our vehicles. Dry storage on board is limited.

13.7 Damage to our equipment

You are liable for the reasonable cost of repair or replacement of our vessels, rods, reels, tackle or other equipment that is lost or damaged by your wilful act, recklessness, or use contrary to your guide's instructions. Ordinary breakage in the course of fishing is our cost, not yours.

14. Merchandise store

[THIS SECTION NEEDS YOUR NUMBERS — every bracketed item below.]

Orders. An order you place through our online store is an offer to purchase. A contract is formed when we send you a dispatch confirmation. We may decline an order, for example where an item is out of stock or a pricing error has occurred, and will refund you in full.

Prices and payment. Merchandise prices are in Canadian dollars and exclude applicable taxes and shipping unless stated. Payment is taken in full at the time of order and is processed by Square.

Availability. Stock is limited and items are sold subject to availability. Where an item becomes unavailable after you order, we will contact you to offer a substitute, a backorder or a refund.

Product descriptions. We describe our products as accurately as we can. Colours may appear differently on your screen, and sizing may vary between manufacturers. Minor variations do not make an item faulty.

Shipping. We ship to [COUNTRIES — e.g. Canada and the United States]. Shipping rates are shown at checkout. Orders are normally dispatched within [X] business days and delivered within [X] business days thereafter. Delivery timeframes are estimates, not guarantees. Risk in the goods passes to you on delivery. You are responsible for any customs duty, import tax or brokerage fee on an order shipped outside Canada.

Collection in person. [STATE whether orders can be collected at your office, and by when.]

Returns and exchanges. You may return an unworn, unwashed item in its original condition and packaging within [X] days of delivery for a refund or exchange. Contact us at info@bcsportfishinggroup.com first to arrange the return. [STATE who pays return shipping.] [STATE whether sale items, gift cards and custom or personalised items are excluded — they usually are.]

Faulty or incorrect items. Nothing in this section affects your statutory rights. If an item arrives faulty, damaged or not as ordered, tell us within [X] days of delivery and we will arrange a replacement or a full refund including shipping, at your choice.

15. Gift cards and the Harrison Sturgeon Challenge

Gift cards. Unless stated otherwise: gift cards are redeemable only against our Services; they are not redeemable for cash and are not reloadable; they are transferable but we are not responsible for a gift card that is lost, stolen or used without authorisation; and any booking made with a gift card remains subject to these Terms, including the cancellation policy. Consistent with British Columbia's Business Practices and Consumer Protection Act, gift cards we issue do not carry an expiry date on the funds, except where permitted by law.

Harrison Sturgeon Challenge. Entry to the derby is governed by the separate Harrison Sturgeon Challenge Rules [LINK — these need to be written and published: entry fee and deadline, eligibility, team composition, boat assignment, fishing hours and boundaries, scoring and measurement method, verification, tie-breaks, disqualification, prizes and their value, tax treatment of prizes, the organiser's decision being final, and how disputes are handled]. Where those rules conflict with these Terms, the derby rules govern the derby. Entrant names, team names and results are published as part of the competition — see our Privacy Policy.

16. Assumption of risk

Please read this section carefully. It describes risks that are inherent in the activities we offer.

Guided sportfishing and boating on British Columbia's rivers and coastal waters involves inherent and significant risks, dangers and hazards that cannot be eliminated regardless of the care taken. These include, without limitation:

  • drowning, immersion, cold-water shock and hypothermia;
  • capsize, collision, grounding, falling overboard, and being struck by or thrown against a vessel or its fittings;
  • swift and changing currents, tides, freshet, high or low water, standing waves, wakes from other vessels, and submerged or partly submerged obstacles including rocks, gravel bars, logs and deadheads;
  • sudden or severe changes in weather, including storms, lightning, high wind, fog, extreme heat, extreme cold and wildfire smoke;
  • injury from hooks, lures, weights, knives, rods, reels, lines and other fishing tackle, including injury caused by another angler;
  • injury from handling large, powerful fish, including strain, sprain, laceration, back and shoulder injury, and being pulled off balance or overboard;
  • slips, trips and falls on docks, boat ramps, gravel bars, shorelines and wet or uneven surfaces;
  • encounters with wildlife, including bears, and with insects;
  • physical exertion, fatigue, dehydration, sunburn and exposure;
  • equipment or vessel failure;
  • the negligence of other participants or of other persons on the water;
  • remoteness from medical facilities, and consequent delay in obtaining medical assistance or evacuation, which on some of our waters may be substantial; and
  • negligence on the part of BC Sportfishing Group, its owners, directors, officers, employees, guides, skippers, agents, contractors and volunteers, including a failure to safeguard or protect you from the risks described here.

By booking and participating, you acknowledge that you are aware of these risks, that you have had an opportunity to ask questions about them, and that you freely accept and fully assume all such risks and the possibility of personal injury, death, property damage and loss resulting from them.

We strongly recommend that you obtain travel, medical and cancellation insurance appropriate to the activities you have booked, and that you check that your policy covers guided fishing and boating activities and the waters you will be on. We do not provide insurance for participants.

17. Limitation of liability

Nothing in these Terms excludes or limits our liability for anything that cannot be excluded or limited by law, including liability for death or personal injury caused by our negligence to the extent that such liability cannot lawfully be excluded, for fraud or fraudulent misrepresentation, or under the mandatory provisions of the Business Practices and Consumer Protection Act (British Columbia) or the Sale of Goods Act (British Columbia) that apply to you as a consumer.

Subject to that paragraph, and to the maximum extent permitted by law:

  1. We are not liable for any indirect, incidental, special, consequential, exemplary or punitive loss or damage, or for loss of profit, revenue, enjoyment, opportunity or holiday time, however arising, whether in contract, tort (including negligence), under statute or otherwise, even if we have been advised of the possibility of such loss.
  2. Our total aggregate liability arising out of or in connection with a booking, a Service, an order or your use of the Website is limited to the total amount you paid us for the Service or order giving rise to the claim.
  3. We are not liable for the acts or omissions of any third party we do not control, including accommodation providers, golf courses, caterers, resellers, online travel agencies, transport providers, other charter operators, and the operators of any dock, launch site or venue.
  4. We are not liable for any loss or damage arising from your failure to follow a guide's instructions, your misrepresentation of your fitness, age or medical condition, your failure to hold a valid licence, your breach of fisheries regulations, or your breach of these Terms.
  5. We make no representation or warranty as to fishing success, catch rates, fish size, water conditions or weather.
  6. The Website is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free, secure, or free of viruses, and we are not liable for any loss arising from your use of, or inability to use, the Website.

Maritime law. Nothing in these Terms is intended to displace any limitation or exclusion of liability available to us under the Marine Liability Act (Canada) or other applicable maritime law, and we reserve all such rights.

Signed waiver prevails. The waiver and release you sign before participating is a separate agreement. Where its terms differ from this section, the signed waiver governs as between you and us in respect of participation in the activity.

18. Indemnity

You agree to indemnify and hold harmless BC Sportfishing Group, its owners, directors, officers, employees, guides, skippers, agents and contractors from and against any claim, demand, loss, damage, cost or expense (including reasonable legal fees) arising out of or in connection with: your breach of these Terms; your breach of fisheries or boating law; your negligent or wilful act or omission; loss of or damage to our vessels, equipment or property caused by you; or any claim brought by a person for whom you made a booking arising from your failure to bring these Terms and the waiver to their attention.

19. Force majeure

We are not liable for any failure or delay in performing our obligations where that failure or delay results from an event beyond our reasonable control, including: extreme or adverse weather; flood, freshet, drought, wildfire, smoke, earthquake or other natural disaster; a fisheries closure, restriction or regulatory measure; epidemic or pandemic and any related public health measure or government order; war, terrorism, civil unrest or riot; strike or industrial action; failure of public or private telecommunications networks, utilities or transport; the closure of a waterway, dock, launch site or road; or the act, order or restriction of any public authority.

Where such an event prevents us from providing a Service, we will offer you a transfer, a credit or a refund in accordance with section 9, and that will be your sole remedy.

20. Complaints

If something goes wrong, tell your guide at the time, so that we have the opportunity to put it right. If your concern is not resolved, write to us at info@bcsportfishinggroup.com within 30 days of the trip date, setting out what happened and what you would like us to do. We will acknowledge your complaint and respond in writing.

21. Privacy

Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms.

22. Third-party links and services

The Website links to third-party sites and services, including our booking system, payment pages, government licensing portals, accommodation partners and social media. Those services are governed by their own terms and privacy policies. We do not control them, do not endorse them, and are not responsible for them.

23. Changes to these Terms

We may amend these Terms at any time by posting an updated version on the Website. The version in effect at the time you make a booking or place an order governs that booking or order. Your continued use of the Website after an update means you accept the amended Terms.

24. Governing law and jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them, their subject matter or formation (including non-contractual disputes or claims), are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable in that province.

You and we submit to the exclusive jurisdiction of the courts of British Columbia, and agree that any proceeding will be commenced in Chilliwack or Vancouver, British Columbia. Nothing in this section limits any right you may have under mandatory consumer protection law in your country of residence to bring proceedings in your local courts.

25. General

  • Entire agreement. These Terms, together with our Privacy Policy, your booking confirmation and any waiver you sign, form the entire agreement between us in relation to your booking and supersede any earlier understanding.
  • Severability. If any provision of these Terms is found to be invalid or unenforceable, it will be severed or read down to the minimum extent necessary, and the remaining provisions will continue in full force.
  • No waiver. Our failure or delay in enforcing any provision is not a waiver of it.
  • Assignment. You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations on notice to you.
  • No partnership or agency. Nothing in these Terms creates a partnership, joint venture or employment relationship between us.
  • Third parties. Except for the indemnities and limitations of liability, which our owners, directors, officers, employees, guides, skippers, agents and contractors may enforce, no person who is not a party to these Terms may enforce them.
  • Headings. Headings are for convenience only and do not affect interpretation.
  • Language. These Terms are drawn up in English. Where we provide a translation, the English version prevails.
